What is Workers Compensation?

Workers Compensation is a no fault workplace insurance program which provides benefits to workers who have a workplace injury and protects employers from the threat of workplace law suits.

The Workers Compensation program is governed by an Act, which is a law of the Province of Prince Edward Island. The Workers Compensation Act entitles an injured worker to compensation benefits when there is a work related injury. Compensation benefits may include medical services, wage loss benefits, as well as rehabilitation services.

The Workers Compensation Board (WCB) also acts in partnership with workers, employers and others to increase understanding of the need for safe and healthy workplaces and to encourage the development of standards to promote health and safety in the workplace.

Employers collectively pay for the cost of workers compensation by contributing to an "accident fund." The amount paid by employers depends on their industry group and the size of their payroll.

Compensation for workers is paid by WCB out of the accident fund. Workers do not contribute to the fund, nor does government. The workers compensation system is funded entirely by employers.

A major benefit to employers is that the compensation to workers takes the place of the workers' right to sue the employer for damages. Employers are also protected from legal action by any other worker or employer covered by the Act.
