Appealing a decision

If you disagree with a decision made on your claim, you have the right to appeal.

If you do not understand or agree with a decision, first contact your WCB case manager for an explanation. You can find the contact information on your decision letter. Many concerns can be resolved by communicating with your case manager.

If you still disagree with a decision, the first step in the WCB appeal system is to send a written request for Internal Reconsideration.

What is Internal Reconsideration?

Internal Reconsideration is the process where the WCB, at the request of a person with a direct interest, reviews its previous decision in a claim or assessment matter and confirms, varies, or reverses that decision. This process is handled by the WCB’s Internal Reconsideration Officer.

Who can request an Internal Reconsideration?

Anyone with a direct interest in the decision(s) related to a worker’s claim can request Internal Reconsideration. That includes the worker, dependents of a deceased worker, and the employer (where that decision has a direct financial, legal, or operational impact on that employer).

When can I request Internal Reconsideration?

Requests for Internal Reconsideration must be submitted to the WCB within 90 days of the date of the decision.

How do I request Internal Reconsideration?

Complete the Request for Internal Reconsideration form and submit it to the WCB.

You can download and complete a fillable form, which you can submit to the WCB by email:

Appealing an Internal Reconsideration decision

Internal Reconsideration is the first level of appealing a WCB decision. If you disagree with the Internal Reconsideration Officer’s decision, you can appeal to the Workers Compensation Appeal Tribunal (WCAT). To do that, you must submit a written application within 30 days of the Internal Reconsideration decision.
